Support to Justice Sector Reforms and Digitalization in Ukraine (PRAVO-JUSTICE II)

The EU Project Pravo-Justice supports the justice sector reforms, including re-set of the judiciary through selection and assessment of judges, restructuring the judiciary, creation of the private enforcement profession and the probation service, setting up electronic registers and strengthening property rights.

The Project’s partners are the High Council of Justice, the Ministry of Justice, the High Qualification Commission of Judges, the Supreme Court, the Council of Judges, the Notary Chamber, and other justice sector institutions.
Obiectivul specific
Tasks as foreseen by the Project's implementation contract:

Specific Objective 1: Improve the management of justice sector reforms by strengthening capacity of relevant JSIs for strategic planning, medium-term budgeting as well as the coordination, monitoring and evaluation of reform implementation in the sector.

Specific objective 2: Strengthen the independence, efficiency, quality, integrity and transparency of the judiciary and the citizens' access to a fair trial.

Specific objective 3: Enhance the enforcement of court decisions: In criminal cases, by establishing an effective system of probation which contributes to reducing the re-offending rate; in civil and administrative cases by increasing the efficiency of enforcement officers (state and private) and improving the foreseeability of property rights.

Specific objective 4: Providing the necessary support for the development and implementation of an IT-strategy in the justice sector and for the piloting or roll-out of e-justice solutions.
Rezultatele așteptate
Expected outcomes of the Project's implementation:

The Expected results (Outcomes), which are brought about by the project's activities, but could not be directly influenced by the project are:

R 1.1. Effective and country-wide implementation of the Justice Sector Reform Strategy and its Action Plans. An efficient and sustainable coordination mechanism for reform implementation is in place.

R 1.2. Performance management and medium-term budgeting (MTEF) is used in the justice sector institutions financing, thus ensuring uninterrupted funding of rule of law sector institutions and providing examples of better budgeting frameworks.

R 1.3. Strengthened involvement of civil society in the reform process in the justice sector, with enhanced capacity of Civil Society Organizations to actively monitor in the area of the quality of implementation of reforms in all of the territory of Ukraine. Dedicated expert community expanded.

R 1.4. Capacity of JSIs for public communication and media relations is improved. Media professionals specialized in justice-sector-related reporting are trained.

R 1.5. Capacity for regulatory development/legislative drafting in the justice sector is improved.

R 2.1. Strengthened independence, quality, efficiency, transparency and integrity of the judiciary (including prosecution) are in line with the new legislation. Merit-based and transparent recruitment in place.

R 2.2. Access to justice and fairness of proceedings are improved.

R 3.1. An effective and accessible system of enforcement of court decisions in place. A person or business can be confident that their legitimate property rights will be protected.

R 3.2. An efficient system of execution of sanctions, especially probation, is in place.

R 3.3. An effective system of state registration of civil status, property and business registration – which the remit of the Ministry of Justice - is in place and is linked with the national interoperability framework, that ensures quality and accuracy of the registered information and can be efficiently used by decentralized service providers.

R 4.1. Adequate e-justice solutions and court security are in place in piloted courts.

R 4.2. An effective system of state registration of civil status, property and business registration – which the remit of the Ministry of Justice - is in place that ensures quality and accuracy of the registered information, is linked with a national interoperability framework and can be efficiently used by decentralized service providers.
